Pavement Licence Update

Rebecca Egan explains the pavement licence update.

2024 – the year in which the pavement licence provisions set out in the 2020 Business and Planning Act, become permanent.

It is anticipated that from the end of March 2024, all pavement licences will be granted solely under the Business and Planning Act across all local authorities in England and Wales, thus removing the sometimes complex and conflicting ways in which you can licence an al fresco dining area currently.   Pavement licences, Tables and Chairs licence and Street Café licences will be streamlined.

Licences will be granted for up to 2 years at a time, and whilst fees will remain capped, these will be increased to £350 for renewal applications and £500 for new applications.  The consultation and decision period are also set to increase to a combined 28 days.

New guidance will be issued in due course and updates from Kuits will follow.
