The Government has corrected its previous guidance on Martyn’s Law as to who the responsible person is where a premises is leased to a tenant. The previous examples given by the Government had suggested that in circumstances where there was a Brewery owned premises but leased to a tenant it would be the Brewery that would be the responsible person. The correction makes it clear that whilst the Brewery is the licence holder, it is the tenant who is the responsible person.
