The Ministry of Housing, Communities and Local Government announced on 4th July that there is to be an extensive consultation focusing on strengthening leaseholder protections under Part 4 of the Leasehold and Freehold Reform Act 2024.
Many owners of leasehold properties currently face uncertainty relating to fees and charges associated with their properties, and many have concerns about the service they are receiving from managing agents responsible for management of the buildings and estates.
The consultation proposes stronger rights, powers and protections for the estimated five million leaseholders in England and Wales, and will grant them the ability to challenge service charges and unfair practices.
Under the proposed changes, managing agents will be subject to mandatory qualifications, and service charge documentation will be standardised and thus more transparent. Leaseholders will have the right to ‘veto’ a freeholder’s choice of managing agent, or to demand a change if the existing managing agent isn’t providing an adequate service.
The announcement of the consultation has been welcomed by industry professionals and leaseholders alike, and is available to comment on until 26th September 2025.
