Secretary of State for Housing, Communities and Local Government Robert Jenrick yesterday announced new guidelines to allow the housing market to resume in England. The government said that from today, provided social distancing guidelines were followed, estate agents’ offices could open, buyers and renters will be able to view properties in person, show homes could open, and removals firms could return to work.
People had previously only been allowed to move home where it was “reasonably necessary”. Estate agents were banned from listing new properties and house hunters had only been able to make online viewings.
Property markets in Wales, Scotland and Northern Ireland remain under lockdown regulations.
Mr Jenrick also unveiled new guidance to allow extended working hours on construction sites and to make the planning system operate remotely. He said that builders would be able to agree more flexible construction site working hours with their local council, such as staggering arrival times to ease pressure on public transport.
In general terms, homemovers may encounter delays in parts of the conveyancing process with respect to, for example, search results and valuations. However, the greater risks may be around the exchange and completion process itself. This will be particularly true if we encounter a second wave of the outbreak and lockdown measures become more stringent once again.
In our view, in most circumstances, we would recommend that our clients consider exchanging and completing on the same day. Ensuring that all monies and people are where they are supposed to be immediately prior to completion removes the possibility of default and ensures that transactions will complete where all parties are ready to do so on the day of completion itself.
