SDLT Relief for First-Time Buyers ends in March
15-Feb-2012Stamp duty land tax (SDLT) relief for first-time buyers will expire on 24 March 2012. There are no transitional provisions therefore any transaction with an effective completion date after this cannot benefit from the relief, irrespective of the date of any contract or agreement.
An effective completion date is usually the same as the completion date, but is defined by HMRC as occurring when the contract is “substantially performed” i.e. when the purchaser takes possession of the property, or receives the rents and profits from it, or if a substantial amount of the consideration is paid, typically more than 90%.
As the 24th March 2012 is a Saturday, buyers would need to complete their purchase by Friday 23 March 2012.
