The Mental Capacity Act sets out a framework which protects people who do not have mental capacity to make every day and life changing decisions such as financial decisions.The Court of Protection is a safeguard for vulnerable people and deals with their health, personal and financial affairs.
Lasting Powers of Attorney (LPAs) and Enduring Powers of Attorney (EPAs) are registered with the Office of the Public Guardian. If an LPA or EPA has not been registered with the Office of Public Guardian before the individual loses mental capacity an application must be made to the Court of Protection.
