Competition Law

Competition law applies throughout Europe and is regulated by the EU Commission and in the UK by the Office of Fair Trading. It prevents anti-competitive activity such as price-fixing or abuse of a monopoly when, for example, an enterprise holds a dominant position.

Intellectual property rights are an exception to the regime which prevents distortion of the market. We have expertise in a number of related areas and in relation to a number of anti-competitive practices affected by the above, including:
  • exercise of intellectual property rights price fixing
  • cartel and dominant position issues.

Our non contentious intellectual property team advises on the relevance to licensing and joint-venture agreements.
